These Terms and Conditions govern your use of the website at beverlyhillstreecare.com and any services provided by Beverly Hills Tree Care ("we," "us," or "our"). By using our website or engaging our services, you agree to these terms. If you do not agree, please do not use our website or engage our services.
By accessing our website, submitting a contact or estimate request form, or hiring us to perform services, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you are acting on behalf of a business or property owner, you represent that you have the authority to bind them to these terms.
Beverly Hills Tree Care provides residential and commercial tree services in Beverly Hills, CA and surrounding areas, including but not limited to tree removal, tree trimming, tree pruning, stump grinding, stump removal, land clearing, emergency tree service, and commercial tree service.
All services are subject to a written scope of work agreed upon before work begins. We reserve the right to decline any job that we determine to be unsafe, outside our service area, or otherwise outside the scope of services we provide.
Estimates provided by Beverly Hills Tree Care are based on information available at the time of assessment. Estimates are valid for 30 days from the date issued unless otherwise stated in writing.
Final pricing may differ from an initial estimate if conditions at the job site differ materially from what was assessed - for example, if additional hazards are discovered during work, if site access is more limited than anticipated, or if the scope of work expands at the customer's request. We will communicate any significant change in scope or pricing before proceeding with additional work.
Free estimates are provided at no obligation. Receiving an estimate does not create a contract or obligation on either party.
Once a job is scheduled, we will confirm the appointment date and time. We ask that you notify us at least 24 hours in advance if you need to reschedule.
We reserve the right to reschedule jobs due to weather conditions, equipment issues, or other circumstances beyond our control. We will notify you as soon as possible if a rescheduling is necessary and work with you to find an alternative date.
If a job requires a permit, scheduling is contingent on permit approval. We will keep you informed of permit status throughout the process.
Payment terms will be specified in your written estimate or invoice. Unless otherwise agreed in writing, payment is due upon completion of the work. We accept payment by cash, check, or electronic transfer as specified on your invoice.
Invoices not paid within 30 days of the due date may be subject to a late fee. If collection becomes necessary, you agree to reimburse our reasonable costs of collection, including attorney fees where permitted by law.
For large or multi-phase jobs, we may require a deposit before work begins. Deposit terms will be stated in your written estimate.
Before work begins, you are responsible for:
Many tree removal and trimming jobs in Beverly Hills and surrounding cities require permits. Where we identify that a permit is required, we will assist with the permit application process as part of the job. The cost of any required permits will be included in or added to your estimate.
You are ultimately responsible for ensuring that any work performed on your property complies with applicable city, county, HOA, and state regulations. We will make reasonable efforts to identify permit requirements but cannot guarantee that all requirements are known at the time of estimate.
We stand behind the quality of our work. If you are not satisfied with a completed job, contact us within 7 days of completion at sales@beverlyhillstreecare.com or (424) 253-0990, and we will work to address the concern.
We do not warrant that any living tree, plant, or landscape element will survive following our work. Tree care involves living organisms whose response to work cannot be fully predicted. We will perform all work in accordance with recognized industry standards, but we cannot guarantee the health or survival of any plant material.
To the fullest extent permitted by applicable law, Beverly Hills Tree Care's total liability to you for any claim arising from our services or this agreement shall not exceed the amount you paid us for the specific service giving rise to the claim.
We are not liable for any indirect, incidental, consequential, or punitive damages, including lost profits or loss of use, even if we have been advised of the possibility of such damages.
Nothing in these terms limits our liability for personal injury caused by our negligence or for any other liability that cannot be limited by law.
Beverly Hills Tree Care maintains general liability insurance and workers' compensation insurance as required by California law. Certificates of insurance are available upon request before any work begins. You are responsible for maintaining your own property insurance.
We encourage you to contact us directly to resolve any dispute before pursuing formal remedies. If you have a concern about our work or billing, reach out to us at sales@beverlyhillstreecare.com and we will respond promptly.
If a dispute cannot be resolved informally, it shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction. You and Beverly Hills Tree Care each waive any right to a jury trial.
These Terms and Conditions are governed by the laws of the State of California, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought in the state or federal courts located in Los Angeles County, California.
